Two storefronts on El Camino Real can have the same square footage and the same frontage and still cost very different amounts to put to work. One becomes a dental office. The other becomes a 50-seat restaurant. Atascadero's municipal code requires the owner of an existing sewer connection that needs more capacity because of a change in development, use or occupancy to apply for a sewer connection permit. The owner must pay any capacity charges due before that permit is issued. The capacity charge depends on the use, and square footage does not set it.
For anyone underwriting commercial, mixed-use or small multifamily property in Atascadero, that permit sits early in the timeline. It sets the cost of the building's most valuable use, and the city has spent the past year changing both the price and how owners can pay it.
The Unit That Prices Every Connection
Atascadero bills sewer service in Equivalent Dwelling Units, or EDUs. One EDU equals the estimated flow of a single-family home, about 240 gallons a day. Other uses are assigned a multiple or a fraction of that. The same multiple drives two separate costs. One is a one-time capacity charge paid when capacity is added. The other is a recurring service charge that shows up on the county property tax bill as "ATAS SEWER CHARGE."
Resolution 2025-061, adopted October 14, 2025, set the capacity charges below, effective December 14, 2025. The monthly figures come from the city's Proposition 218 notice for fiscal year 2026-27.
| Use | EDU multiple | Capacity charge, Dec. 2025 schedule | Monthly service charge, FY 2026-27 |
|---|---|---|---|
| Office or commercial unit | 1.00 | $8,856 | $67.60 |
| Apartment or condo, per unit | 0.75 | $6,642 | $50.70 |
| Senior apartment, per unit | 0.35 | $3,099.60 | $23.66 |
| Bar | 1.50 | $13,284 | $101.40 |
| Restaurant, under 40 seats | 4.00 | $35,424 | $270.40 |
| Restaurant, 40 to 60 seats | 6.00 | $53,136 | $405.60 |
| Restaurant, 61 to 100 seats | 8.00 | $70,848 | $540.80 |
| Restaurant, over 100 seats | 10.00 | $88,560 | $676.00 |
| Gymnasium | 10.00 | $88,560 | $676.00 |
Two details in that table matter most to a buyer. The restaurant tiers go by seat count, so the dining room layout is also a sewer decision. And a small restaurant pays four times the capacity charge of an office unit in the same building, while one with more than 100 seats pays ten times as much.
The capacity figures are a base, not a fixed price. The resolution adjusts them every July 1 by the change in the Engineering News Record Construction Cost Index. The December 2025 numbers have already gone through one adjustment cycle, so the figure that applies to a specific permit has to come from the city.
Why Both Numbers Are Climbing
The reason for all of this is a treatment plant. The city's Water Reclamation Facility east of Chalk Mountain Golf Course is a lagoon-and-percolation-pond system with a design flow of 1.4 million gallons a day. Its replacement is expected to cost more than $100 million, which Atascadero News reported would be the largest capital investment in the city's history. The city's Prop 218 materials put total wastewater capital needs, including lift stations, force mains, pipes and manholes, at more than $170 million over the next ten years.
Both revenue streams fund that work. Under the resolution, capacity charges are based on the value of existing capacity plus planned replacement and growth projects. When the resolution took effect, the single-family charge went from $6,769 to $8,856. On the service side, the Prop 218 notice raised the monthly single-family charge from $57.06 to $67.60 starting July 1, 2026, an increase of about 18.5%.
That percentage matches a recommendation the city has already put on paper. The March 10, 2026 staff report says the wastewater rate study recommends annual increases of 18.5% "over the next several years." It also says future increases tied to the plant retrofit will come up over the coming year. Staff wrote that Atascadero's rates were below the San Luis Obispo County median as of January 2026, but that "major required capital improvements will likely move Atascadero's rates above the median in future years." The 18.5% figure is a study recommendation, not an adopted multi-year schedule. Each future increase goes through its own Prop 218 notice and hearing.
For an investor, the recurring charge is an operating expense that scales by EDU. At the FY 2026-27 rates, a ten-unit apartment building carries $507 a month in sewer charges, or $6,084 a year. A restaurant with more than 100 seats carries $676 a month, or $8,112 a year. Both are billed through the property tax bill, so they land on the owner's side of the ledger unless a lease passes them through.
October 13: The Council Prices the Restaurant Problem
On October 13, 2026, the city council voted 5-0 to approve a Wastewater Capacity Charge Deferral Program for new businesses. Atascadero News reported that the program lets a business defer up to 75% of the capacity charge and repay it over three years with interest. Total deferrals are capped at $300,000 in the first year, and the program will be reviewed after twelve months. City Manager Jim Lewis tied it directly to downtown, as the paper quoted him:
"Many restaurants and venues downtown require sewer connections and the council has been very concerned about making sure we're prudent in pre-funding the wastewater plant, and make sure the fee, while they are where they need to be, aren't so cost-prohibitive as to stifle restaurants and entertainment."
Run the December 2025 schedule through those terms. A restaurant with fewer than 40 seats has a $35,424 capacity charge. Deferring the maximum 75% leaves $8,856 due at permit, the same as the full charge for a single office unit. The remaining $26,568 is repaid over three years with interest. In effect, the program lets a small restaurant open for roughly the upfront sewer cost of an office tenant and carry the rest as financing.
The $300,000 cap limits how far that goes. At the December 2025 schedule, the maximum deferral on the smallest restaurant tier is $26,568, so the first-year pool covers about eleven such openings. Fewer fit if the applicants are larger restaurants. The newspaper's account also shows that the council discussed who should qualify. Councilmembers said they wanted the program aimed at local businesses rather than large corporate operators. They rejected a proposed one-loan-per-owner limit, and Lewis said staff could monitor the types of businesses admitted without writing that into the policy. The interest rate and application process were not included in the reported terms, so they have to come from the city.
That same evening, the council chose a Moving Bed Biofilm Reactor as the secondary treatment process for the Water Reclamation Facility Replacement Project. It authorized Black & Veatch to prepare the Phase 2 preliminary design report and construction cost estimate for up to $759,696. It also approved a $322,310 contract amendment with Water Systems Consulting to design interim improvements at the existing facility. The construction cost estimate from that work will shape the next round of rate discussions.
What This Does to a Downtown Building
Downtown storefronts keep changing hands between uses. Huckleberry's closed at 6910 El Camino Real, a block from Sunken Gardens, in late January 2026, according to the San Luis Obispo Tribune. Lebber's Pizza opened at 593 Traffic Way on October 1, 2025, as reported in the Tribune's 2025 roundup of local openings. Every move like that into a higher-EDU use goes through the capacity-charge process.
The code says the charge follows "the change in user classification" for an existing connection. The same code chapter says a change to a lower-capacity use keeps a credit for the previous, higher-capacity use. That second clause is the one sellers should know about. A building that once held a restaurant classification may carry that credit forward after an office or retail tenant moves in. That can make the space cheaper to convert back than an otherwise identical building that never had a restaurant. The code does not spell out how the credit is calculated when capacity goes up, so the dollar figure for any specific conversion comes from the city's permit process.
Before writing an offer on an Atascadero commercial or mixed-use property, these checks help:
- Confirm the building is on city sewer. City sewer serves roughly half of Atascadero's 11,000-plus parcels, along with a majority of businesses.
- Read the "ATAS SEWER CHARGE" line on the seller's county property tax bill. The levy shows how many EDUs the parcel is currently billed for.
- Match the EDUs to the business plan. A restaurant, gym or bar concept means a higher classification. Get the current, inflation-adjusted capacity charge from the city before you settle the price.
- Ask about prior uses. A history of a higher-capacity use may carry a credit under the code. Confirm it with the city in writing.
- Model the recurring charge at more than one rate. Use the FY 2026-27 figure along with the 18.5% annual path the rate study recommended, since the plant's cost estimate is still being prepared.
A Few Common Questions
Does the deferral program help a buyer of an existing restaurant? According to the reported terms, the program covers new businesses facing a capacity charge. A sale with no change in classification may not trigger a capacity charge at all. Eligibility should be confirmed with the city.
Are septic properties affected by the plant cost? The city says only parcels connected to and benefiting from city sewer pay wastewater connection and service charges.
Can owners weigh in on future rate increases? Yes. Each increase requires a Prop 218 notice and hearing, and the city's Wastewater Division page explains that only written, signed protests count. A majority protest is 50% of affected parcel owners plus one.
